Seasonable is a seasonal-staff management platform for campsites and holiday parks, operated by Seasonable, based in the Netherlands ("we", "us", "our"). Contact: hello@seasonable.nl.
Accepting these terms
By accessing or using the Seasonable platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.
If you do not agree to these Terms, you must not use the Service.
Description of service
Seasonable provides tools that enable campsite and holiday-park operators ("Operators") to manage their seasonal workforce. Features include availability collection, confirmation workflows, housing assignment, and pay processing. The Service is provided as software-as-a-service (SaaS) and accessed through a web browser.
The Service is intended for business use by Operators. Seasonal staff access the Service at the invitation of an Operator.
Account registration
To use the Service as an Operator, you must register an account and provide accurate, current information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us promptly at hello@seasonable.nl if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Upload or transmit data that is unlawful, harmful, defamatory, or infringes third-party rights.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Use the Service to distribute unsolicited commercial communications (spam).
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or otherwise commercialise access to the Service without our prior written consent.
- Use automated scrapers or bots to access the Service without our written permission.
Operator responsibilities regarding staff data
When Operators upload personal data about seasonal staff (names, availability, housing, pay), the Operator acts as the data controller for that data. Seasonable processes it solely on the Operator's instructions. Operators must ensure they have a valid legal basis under GDPR to share staff data with the Service, and must inform their staff that their data is processed in Seasonable.
A data-processing agreement (DPA) is available on request and forms part of these Terms where applicable.
Intellectual property
All software, design, content, and trademarks within the Service are owned by or licensed to Seasonable. Nothing in these Terms transfers any intellectual property rights to you. You retain ownership of the data you upload to the Service.
You grant Seasonable a limited, non-exclusive licence to host, copy, and transmit your data solely to provide the Service to you.
Availability and uptime
We aim to keep the Service available and performant. However, we do not currently guarantee a specific uptime or service-level agreement (SLA). Scheduled maintenance will be communicated in advance where reasonably possible. We are not liable for disruptions caused by third-party infrastructure, internet outages, or circumstances beyond our reasonable control (force majeure).
Payment and billing
Pricing for the Service is as communicated at the time of subscription or as agreed in writing. All prices are in euros and exclusive of VAT unless stated otherwise. Payment terms are set out in your subscription agreement. We reserve the right to suspend access for overdue accounts after reasonable notice.
Detailed pricing terms will be incorporated here before commercial launch.
Limitation of liability
To the maximum extent permitted by Dutch law, Seasonable's total liability to you for any claim arising out of or in connection with the Service (whether in contract, tort, or otherwise) is limited to the fees you have paid to us in the twelve months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
Termination
Either party may terminate the agreement with 30 days' written notice. We may terminate or suspend your access immediately if you materially breach these Terms or if required by law. Upon termination, we will make your data available for export for 30 days, after which it will be deleted in accordance with our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. We will notify account holders of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you may terminate your account before the effective date.
Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands. If you are a consumer, mandatory consumer-protection provisions of your country of residence may also apply.
